State 'can challenge Obama health care law' in court

Virginia can challenge in court the constitutionality of President Barack Obama's signature healthcare reform law, a judge has ruled. The decision is a setback to the administration, which will now have to defend the law in court in the run-up to the November elections. The state argued the law's requirement that Americans purchase health insurance is unconstitutional. The state's governor and attorney general are Republicans. The Obama administration has argued the requirement is structured like a tax on those who do not purchase insurance and that the federal government has broad constitutional authority to design tax policy. US District Judge Henry Hudson rejected the federal government's motion to dismiss Virginia's suit. He emphasized his ruling was merely an initial step and said the issue was ripe for court review. The Obama administration remains confident the healthcare law was grounded in the constitution. (Click here)

Father of internet Imam plans to sue CIA

The father of the Internet's most famous radical cleric, Anwar al-Awlaki, is planning to sue the U.S. government for including his son on a CIA target list. Nasser al-Awlaki hired the ACLU and the Center for Constitutional Rights last month to file a lawsuit that would question whether his American-born son can be on the CIA's "capture or kill" list. A lawsuit ultimately could seek an injunction to get him removed from the list. That lawsuit hasn't been filed. But it would mark the first legal challenge to the military and CIA target lists.

Fight for funds delays settlement for Madoff victims

A potential multibillion dollar legal settlement that would go to victims of Madoff has been delayed by other lawsuits competing for the same funds. The suits, which seek class-action status, were filed for Madoff investors whose claims were rejected entirely or in part by Irving Picard, a trustee recovering money for the victims, on grounds that they were based on fictitious profits and not actual losses. In addition, federal prosecutors in New York in recent weeks have demanded that the Picower estate forfeit assets on top of what the trustee is seeking.

BP says the "static kill" at the site of the Deepwater Horizon oil spill in the Gulf of Mexico has worked, a major step towards permanently sealing it.

Israeli Arab has 'deception rape' sentence delayed

An Arab man convicted in Israel of rape because he pretended he was a Jew has had his prison sentence delayed. Sabbar Kashur, 30, was found guilty of "rape by deception" when he had consensual sex with an Israeli woman, and sentenced to 18 months in jail. He has appealed against the sentence, and it has now been delayed, pending a high court decision.

Mexico says 28,000 killed in drugs war since 2006

More than 28,000 people have died in drug-related violence since President Felipe Calderon declared war on the drug cartels in 2006. Announcing the latest figures, national intelligence chief Guillermo Valdes said real progress had been made towards breaking the cartels' power. But he said the state was facing a complex challenge from well-organized groups and that violence was growing.

Mexicana files for bankruptcy

Mexico's biggest airline, Mexicana de Aviacion, has filed for bankruptcy protection after failing to reach a deal with trade unions on cost cutting. The heavily-indebted airline said flights would continue while it restructured its finances. Mexicana had proposed deep pay cuts for pilots and crew, as well as a 40% reduction in the workforce.

Brazil debt deteriorates

The risk associated with holding Brazilian bonds relative to Peru climbed to a 20-month high on concern Lula isn't taking advantage of the fastest growth in two decades to cut debt. The cost of protecting Brazil's debt against non-payment for five years with credit-default swaps compared with Peru rose yesterday to 10 basis points, or 0.1 percentage point, the highest since December 2008. As recently as March, Peru's swaps were more expensive than Brazil's. Brazilian swaps are also 11 basis points higher than Panama. All three countries are rated BBB- by Standard & Poor’s. "The fundamentals of Brazil have been deteriorating whereas the fundamentals of Peru and Panama have improved."

Iraq court sentences former Saddam official to death

The Iraqi High Criminal Court said on Tuesday that it has sentenced to death a senior official of former Iraqi dictator Saddam Hussein. Mezban Khadar Hadi, who was a leader in Saddam's Baath Party, will be executed for draining the country's marshlands in an effort quash Shiite resistance in the region. Before his arrest in 2003, Hadi was a member of the Iraqi Revolutionary Command Council, which had both legislative and and executive authorities under Saddam's regime. The court also sentenced Saddam advisor Abdul Ghani Abdul Ghafoor to life in prison and 29 other Baath officials to prison sentences of up to 15 years.

Wikipedia and FBI in logo use row

In a letter sent to Wikipedia's San Francisco office, the FBI said that "unauthorized reproduction of the FBI Seal was prohibited by US law". "Whoever possesses any insignia...or any colorable imitation thereof…shall be fined...or imprisoned... or both," the FBI wrote. The issue centered on the FBI's Wikipedia entry which, in addition to information on the US bureau, also features an image of the "Seal of the Federal Bureau of Investigation". The FBI said that this was "particularly problematic, because it facilitates both deliberate and unwitting violations of restrictions by Wikipedia users". It is not yet known why the FBI has singled out Wikipedia, when the FBI seal is published on numerous other websites.

South Africa court sentences former Interpol president to 15 years

Obama confirms plan for US troop withdrawal from Iraq

Obama has confirmed the end of all combat operations in Iraq by 31 August. Some 50,000 of 65,000 US troops currently in Iraq are set to remain until the end of 2011 to advise Iraqi forces and protect US interests.

EU ends security reform in Guinea-Bissau over breakdown of law and order

The EU on Monday declined to renew its mandate of reforming Guinea-Bissau security forces, citing the breakdown of law and order in the country. The EU SSR Guinea-Bissau Mission was first launched in June 2008 and was intended to provide assistance to the west African nation's security forces in developing a legal framework in which to implement a national security sector reform.

Guantanamo trial set to go ahead

The U.S. military is moving ahead with the first trial under the Obama administration's new military commissions, despite U.S. officials' concerns about starting with a Guantanamo-detainee case beset by troubles.

Obama signs Fair Sentencing Act

Obama signed into law the Fair Sentencing Act, which narrows the huge disparity in punishment given to those convicted of possessing crack cocaine versus those found with the drug in powder form. The gap has been of particular concern to the African-American community. Crack users tend to be poorer than those who use powder - and disproportionately African-American. The new law, passed through rare bipartisan compromise, narrows that 100 to 1 ratio to 18 to 1. Obama campaigned on a platform that included closing the sentencing gap, but some legal activists are calling for it to be narrowed even further.

20 law professors back ACLU in suit

Twenty professors of legal ethics from law schools around the country are named in a brief filed in Superior Court Monday which accuses former Family Court Chief Judge Jeremiah S. Jeremiah Jr. and the magistrates who run the state's Truancy Court program of attempting to stifle the free-speech rights of two lawyers representing the American Civil Liberties Union and its Rhode Island affiliate. Lawyers representing Jeremiah and the magistrates have asked a Rhode Island Superior Court judge to bar the ACLU's New York lawyers from participating in a class-action lawsuit the ACLU filed for their clients because the ACLU lawyers made public statements against the Truancy Court during a news conference last March. UK coalition government sued over emergency budget's effects on women

A UK-based women's rights group filed suit Friday against the new coalition government over its 2010 budget, claiming the drastic spending cuts in it will have a disproportionately negative impact on women. The accusation stems from a gender impact study commissioned by Labour Party MP and Shadow Minister for Women and Equalities Yvette Cooper and conducted by the House of Commons Library, which found that 72 percent of the £10.5 billion in budget cuts would be shouldered by women.
