This is to inform you about the proximity of the terms set forth in the Circular No. 3.822/17 of the Brazilian Central Bank, for companies recipients of foreign investment to declare their economic-financial information at the Brazilian Central Bank System.
This year, Brazilian companies recipients of foreign direct investment with net equity and assets in an amount equal to or higher than R$ 250 million, shall present to the Brazilian Central Bank, on a quarterly basis, the economic-financial declarations, according to the following base-dates, as of January 30th, 2019:
(i) until June 30, in relation to the base-date of March 31;
(ii) until September 30, in relation to the base-date of June 30;
(iii) until December 31, in relation to the base-date of September 30; and
(iv) until March 31, in relation to the base date of December 31, of the previous year.
The companies recipients of foreign direct investment with net equity and assets in an amount lower than R$ 250 million, shall update, annually, up to March 31 of the following year, the information related to the net equity and paid-in capital stock amounts, including the portion of capital stock held by each foreign investor, taking into consideration the base-date of December 31 of the previous year.
It is important to stress that the registration of the foreign direct investment at the Brazilian Central Bank System, as well as the veracity of the information and the maintenance of the supporting documents is under the sole responsibility of the recipient company. In case of incorrect, incomplete or untimely information, the responsible party will be subject to the imposition of fines.
